The Federal Trade Commission (FTC) has taken a significant step toward addressing the problem of fake online reviews by proposing a rule to ban deceptive practices. To enhance the reliability and trustworthiness of the online review ecosystem, the FTC aims to curb fabricated, repurposed, and manipulated reviews that mislead consumers and undermine the integrity of online platforms.

The Need for Action

The prevalence of fake reviews on platforms like Amazon, Google, Yelp, and others has become a persistent issue. Bad actors have exploited fake reviews to artificially boost product rankings, manipulate consumer perception, and influence purchasing decisions. These deceptive practices harm consumers and create an unfair advantage for unscrupulous businesses.

Proposed Prohibitions and Penalties

The proposed rule by the FTC seeks to address several key areas of concern related to fake reviews. If finalized, the rule would ban the selling or solicitation of fake reviews, review hijacking, buying positive or negative reviews, undisclosed reviews from company leadership or related individuals, running biased review sites, suppressing reviews through legal threats, and selling fake engagement. By targeting these specific practices, the FTC aims to deter the creation and dissemination of fake reviews, thereby restoring trust in online review platforms.

Violators of the proposed rule would face civil penalties, with fines potentially reaching up to $50,000 per fake review encountered by consumers. The enforcement of these penalties would primarily focus on U.S. companies involved in fake review activities. While the FTC recognizes the challenges in targeting foreign entities, it can take action against U.S.-based companies engaged in deceptive practices.
